birthday treats at ace adventure resortYou’ll want to start thinking about making your plans and reservations to come down for ACE's 30th birthday bash, coming up May 16 and 17, and we can give you several reasons why:


1. Um, four words: awesome spring whitewater rafting. (We do have Spring Specials, by the way.)


2. A pig roast, music, volleyball, tons of cake, and all the stuff you’d expect at a birthday party.

3. The newly expanded beach at the lake. We’ve had heavy machinery laboring all winter, scooping out muck a shovelful at a time, dumping sand, creating more beachy goodness. There’s about 200 yards more suntanning real estate now (and still all the awesome inflatable jungle gym toys). It’s a must-see-and-do.


4. We don’t play pin the tail on the donkey at our birthday party. We play paintball, go rock climbing, zip around on the canopy tour, ride ATVs, mountain bike, kayak, fish and ride horses.

ACE Adventure Resort celebrates 30th birthday with $30,000 giveaway

For some lucky whitewater fans, earning 30 years of free rafting trips will be almost as easy as saying, “Happy birthday.”


ACE will reward 10 creative fans with a free rafting trip each of the next 30 years. We’re celebrating our 30th birthday in May, and the contest is a major part of the celebration.

To vie for a prize, entrants must submit a 30-second “happy birthday” video to the ACE Adventure Resort pages on Facebook or YouTube. The catch is that contestants cannot use the traditional “Happy Birthday To You” song.


A bit of trivia: Although the current state of the copyright is contentious, the rights to the song are privately owned. Consequently, the song never appears on television or film in its entirety without producers paying significant royalties to the rights-holders. It’s also the reason many restaurants sing their own, original birthday songs to patrons. According to the urban legend debunking website snopes.com, the song earns owner Warner Chapell about $2 million annually. The copyright is set to expire in 2030.

We don’t want to hear the same birthday song over and over. We decided the contestants could come up with their own, creative way to wish us a happy birthday. There’s a lot of self-expression in the whitewater world, and our guests are no different. This is our way of letting you show off and rewarding you for it.

The contest runs through May 1, 2009, and we’ll announce the 10 winners before our 30th birthday bash, scheduled for May 16 and 17 at the ACE basecamp in Oak Hill, WV.

ACE's 30th Birthday Contest

No purchase required to enter or win. Void where prohibited.

By participating, each entrant to the ACE Adventure Resort 30th Birthday Contest (“Contest”) fully and unconditionally agrees to and accepts these Official Rules

ACE Adventure Resort (“ACE”) is offering this promotion only legal residents of the 50 United States and the District of Columbia and Canada who are at least 18 years old. Employees of ACE and their immediate family (spouse, parents, siblings, and children) and household members of each employee are not eligible to win.

Contest winners will be determined at the discretion of ACE management.

To enter the Contest: Entrants must submit one (1) video, no more than thirty (30) seconds in duration to either the ACE Adventure Resort Facebook Page and/or the ACE Adventure Resort YouTube Page.


Facebook entries must be posted to the ACE Facebook Page “Wall.”
YouTube entries must be posted as a “Video Comment” to the “ACE 30th Birthday Video Contest Rules” video.

Identical videos posted to both the ACE Page on Facebook and the ACE Page on YouTube will be considered as one entry.
In each Contest video: Entrants must include their name, age, hometown and contact information (phone and email). Entrants must wish ACE a happy 30th birthday, but must NOT sing the song “Happy birthday to you.”
Each video must make clear the identity of the person vying for a Contest prize. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
Videos may be submitted until 11:59 p.m. EST, April 30, 2009. Enter as often as you like.
Entries must also comply with all Facebook and/or YouTube terms of service. Entries containing nudity and/or profanity will be disqualified and removed from ACE Pages on Facebook and YouTube.
All entries become the exclusive property of ACE, and none will be acknowledged or returned.

Entrants selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Except where prohibited, potential winners may be required to sign and return to ACE, within ten (10) business days of being notified, an affidavit of eligibility and liability/publicity release in order to claim his/her prize. If a potential winner cannot be contacted within three days (72 hours) after the first attempt to contact him/her or if he/she fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, an alternate entrant may be selected in his/her place at random from among all eligible entries received.

Prize:

Representatives chosen by ACE will select a total of ten (10) winners. Winners may be chosen from individual and group entries. Each winner will receive one (1) free rafting trip on the New River each year for the next thirty (30) years. The total present retail value of each prize is approximately $3,000.
Winners will be announced via ACE on the Facebook and YouTube pages, the ACE website and ACE Blog. Winners will be announced by May 2, 2009. Winners must contact ACE within ten (10) days to confirm acceptance of the prize.

Prize is subject to availability at time of booking. Blackout periods might apply. Booking restrictions apply and due to capacity controlled seating, flexibility of prize redemption dates may be necessary. Once booked, reservations may not be changed. The Prize winner will be responsible for all expenses not specifically stated as part of the Prize, including but not limited to, any taxes, service charges, local transportation, overnight accommodation prior to or following the rafting dates, income taxes, insurance, gratuities, all meals (except for lunch included on all-day trips), beverages, incidentals and any items of a personal nature.
Prize must be accepted as awarded with no substitution. Prize is non-transferable and cannot be redeemed for cash or credit, in whole or in part. Any expenses not specified are the sole responsibility of the winner.
This prize has no cash, redemption or barter value. No alternative prize, cash equivalent, or other substitution is permitted.

Publicity:

Except where prohibited, participation in the Contest constitutes winner's consent to ACE’s use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.

General Conditions: ACE reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond ACE's reasonable control impairs the integrity of the Contest, as determined by ACE in its sole discretion. In such event, ACE reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. ACE reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and, should such an attempt be made, ACE reserves the right to seek damages from any such person to the fullest extent permitted by law. ACE's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Release:

By entering this Contest, entrant agrees to release and hold harmless, ACE Adventure Resort, the prize sponsor, each of its related companies, and each of its respective officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize.

Limitations of Liability:

ACE is not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Contest; (iv) electronic or human error which may occur in the administration of the Contest or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest.

Disputes:

Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with ACE’s Contest, or any prizes awarded, other than the administration of the Contest or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of Virginia or the appropriate West Virginia State Court ; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of West Virginia, without giving effect to any choice of law or conflict of law rules (whether of the State of West Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of West Virginia.
